SAP 013-608-009 WHEREAS, the Chisago County is preparing plans for the CSAH 8 (Cedarcrest Trail) bridge number 7214 replacement project; and WHEREAS, Minnesota Rules for State Aid Operation 8820.9920 require minimum design speed of 40 MPH; and WHEREAS, the existing reverse horizontal curve approach south of the existing bridge is currently posted at an advisory speed of 35 MPH; and WHEREAS, the existing reverse horizontal curve does not meet current design standards for a 40 MPH roadway and is not superelevated; and WHEREAS, constructing a horizontal curve to meet the 40 MPH design criteria would cause significant environmental impacts onto Goose Lake and encroachments onto private properties, and WHEREAS, there is no history of accidents at the curves to suggest that constructing to a 40 MPH design speed would significantly improve the safe operation of the roadway, and WHEREAS, the proposed design using a 35 MPH curve coupled with the introduction of superelevation does significantly increase the safe operation and navigation around the curve. NOW, THEREFORE, BE IT RESOLVED, that the Chisago County Board of Commissioners do hereby request a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9920 (Geometric Design Standards, Rural; New or Reconstruction Projects) to allow 35 MPH horizontal curve in lieu of 40 MPH horizontal curve; BE IT FURTHER RESOLVED, that the Chisago County Board of Commissioners hereby indemnifies, saves and holds harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the variance.
