CHISAGO COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS WEDNESDAY, JUNE 19, 2013 The Chisago County Board of Commissioners met in regular session at 3:30 p.m. Wednesday, June 19, 2013 in the Board Room of the Government Center with the following Commissioners present: Greene, McMahon, Montzka, and Robinson. Also present: Assistant County Attorney Kristine Nelson Fuge, County Administrator Bruce Messelt and Interim Clerk of the Board Chase Burnham. The Chair called the meeting to order and led the assembly in the Pledge of Allegiance. The Chair excused Commissioner Walker from the meeting. The County Administrator introduced the County's summer interns, Emma Stevens and Erik Haugan, to the Board. Commissioner McMahon offered a motion to approve the Agenda for the Board of Commissioners meeting. Motion seconded by Greene and upon a vote being taken thereon, the motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. On motion by McMahon, seconded by Greene and carried unanimously the Board recessed the board meeting to a time immediately following the meeting of the Road and Bridge Committee. Commissioner McMahon offered the following resolution and moved its adoption: RESOLUTION NO. 13/0619-1 THE ACQUISITION OF REAL PROPERTY IN ACCORDANCE WITH MINNESOTA STATUTES SECTION 117 WHEREAS, Chisago Lakes Lake Improvement District is a political subdivision of the County of Chisago in the State of Minnesota and is organized and existing under the laws of the State of Minnesota with all the powers as granted to exercise as authorized by said County; and WHEREAS, CCLID does not have independent authority to acquire property by condemnation in accordance with Minnesota law including but not limited to, Minnesota Statutes Chapter 117 and must rely upon the authority of the Chisago County Board of Commissioners for said action; and WHEREAS, CCLID has previously determined that it is reasonably necessary and in the best interest of the health, safety, and welfare of the citizens of the County to acquire perpetual easements across the real property legally described on attached exhibit A and shown on Exhibit B hereto ("Real Property") to facilitate and manage the drainage and flowage of waters on said Real Property; and WHEREAS, the following persons own or have an interest in portion of said Real Property required for easement purposes as shown on attached Exhibit C ("Interested Persons"); and WHEREAS, the acquisition of such easements by County service a public purpose to manage the drainage and flowage of waters on said Real Property; and WHEREAS, County has been unable to successfully acquire the easements through direct negotiations with Interested Persons; and WHEREAS, Chisago County has the right to acquire the right-of-way prior to the filing of an award by the court appointed commissioners, pursuant to Minn. Stat. Sec. 117.012 and Sec. 117.035; NOW THEREFORE BE IT RESOLVED, that the Chisago County Board of Commissioners hereby authorize the acquisition of said easements across the Real Property by eminent domain and to take said interest in the Real Property prior to the filing of an award by the court appointed commissioner, pursuant to Sec. 117.042. BE IT FURTHER RESOLVED, that the Chisago County Attorney is requested to file the necessary Petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed, or terminated by the County or the Court. (A full and complete copy of Exhibit A, B, and C are on file in the Office of the Clerk of the Board.) Commissioner Greene seconded the resolution and upon a vote being taken thereon, the following voted: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker Whereupon the resolution was declared duly passed and adopted. On motion by McMahon, seconded by Greene, the Board moved to support Chisago Lakes Chain of Lakes participation in the northeast Twin Cities study of water supplies and lakes. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. On motion by Greene, seconded by McMahon, the Board moved to deny the Brian Dahedl zoning ordinance amendment request to section 4.12 B. of the Chisago County Zoning Ordinance, with findings of denial as presented by the planning commission. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. 1. Will the amendment create an excessive demand on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area? If approved as proposed, there should be no additional demand upon parks, schools, public facilities or utilities. The RVs would be required to be self-contained, and the RV owners who are coming to Chisago County to recreate at the lake, are unlikely to use public parks or other amenities. There could potentially be additional traffic upon the township roads which generally serve the County's Shoreland developments, but not to a degree likely to cause significant problems. 2. Is the amendment sufficiently compatible so that existing development does not suffer undue negative impact and there will be no significant deterrence to future development? There should be no deterrence to future development if the amendment is approved, as the areas which will be impacted by any influx of RVs are generally already developed into residential and seasonal recreational properties. The question of compatibility is more problematic, as discussed in Item #IX above. 3. Will the amendment cause traffic hazard or congestion? There may be a small increase in traffic on the Township roads serving these areas, but nothing that would be likely to generate any hazard or congestion. 4. Is the amendment in the opinion of the County is reasonably related to the land use goals of the County, and the needs of the greater community? It may be said that the amendment is somewhat related to several of the goals stated in the Chisago County Comprehensive Development Plan, i.e.: Section 2 - Natural Resources: " "[To treat] prime scenic views and landscapes...[as] an increasingly desirable locale amenity drawing outside revenue from visitors, that is vital to the local economy". " "To promote recreational opportunities." Section 7 - Economic Development: " "To promote natural amenities in the County as assets to economic development...". " "To promote tourism as an expanding opportunity...". In the opinion of Staff, it is more difficult to draw a direct relationship between the proposed amendment and the needs of the greater community. Presumably, there may be economic benefits to local businesses from an increase in tourism and visitors to the area. If the land value of "unbuildable" lots rises as a result of increased demand, then there would be a small identifiable economic benefit to the County overall, in terms of revenue. Apart from those two benefits, it is difficult to quantify how the needs of the greater community might be met by approval of this amendment, other than from the government perspective, of generally providing a more practical enforcement method for Zoning Staff in monitoring the 30 day time limit on a case-by-case basis. 5. Is the amendment consistent with the intent and purposes of the Comprehensive Plan, Zoning Ordinance, and other relevant official land use controls? Please refer to the discussion above. On motion by Greene, seconded by McMahon, the Board moved to approve the Stacie Mix Conditional Use Permit request at 26856 St. Croix Trail with conditions as presented by the planning commission. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson, Walker OPPOSED: None. 1. Is the proposal consistent with the Comprehensive Plan and development policies of the County? Yes. The Chisago County Comprehensive Development Plan outlines a number of goals and policies which are meant to support and encourage this type of development, including the following: Natural Resources Goal Section 2-12: Prime scenic views and historic landscapes will be recognized as an important local amenity and an increasingly desirable local amenity drawing outside revenue from visitors that is vital to the local economy. Policies: 1. Identify and protect quality of visitor experience of prime scenic features, areas of exceptional rural ambience, important historic sites and their surrounding settings, and prime areas for flora study and wildlife viewing, and public spaces open to low impact outdoors recreation. Economic Development Goal Section 7-8: Provide for a range of economic diversity and development opportunities in the County. Policies: 1. Promote natural amenities in the County as assets to economic development and business opportunity. 2. Promote tourism as an expanding opportunity for employment and tax base. 2. Will the use create an excessive demand on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area? No such demands were identified by Staff. 3. Will the use be sufficiently compatible or separated by distance or screening from adjacent development or land so that existing development does not suffer undue negative impact and there will be no significant deterrence to future development; and 4. Will the structure and site have an appearance that will have an adverse effect upon adjacent properties? Please refer to the discussion in Item #IX above. 5. Is the use in the opinion of the County reasonably related to the overall land use goals of the County and to the existing land use, and consistent with the purposes of the Zoning Ordinance/Zoning District in which the applicant intends to locate the proposed use? Yes. Chisago County amended its Zoning Ordinance two years ago with the specific intention of allowing and encouraging the development of this type of Rural Tourism attraction. (See Section 5.06 (C) 25 of the Chisago County Zoning Ordinance.) In accordance with that section, it is anticipated that approval of this CUP will: " Preserve and celebrate Chisago County's archaeological properties, rural and agricultural heritage, and historical landscapes; " Recognize Chisago County's scenic features, exceptional rural ambience, and historic sites as desirable local amenities which will draw outside revenue from visitors, that are vital to the local economy. " Enhance Chisago County's appeal to visitors who are drawn to its rural atmosphere; " Provide opportunities for new economic growth through Rural Retail Tourism businesses; " Assist the County's citizens in the transition from primarily agricultural land uses, to an expanded variety of rural business opportunities as active family farming continues to diminish in Chisago County 6. Will the use cause traffic hazard or congestion? There will be additional traffic to and from the site if the proposal is approved, but a formal review by Public Safety professionals has determined that no undue hazard or congestion will result from approval of this application. 7. Will existing nearby properties be adversely affected by intrusion of noise, glare or general unsightliness? It is expected that there will be some additional noise from the business venue, but vegetative buffering should diminish any such impact, along with the ambient noise already present at this busy intersection. No glare is expected to result from the additional business, nor general unsightliness, as the property will benefit from ongoing upgrades, grooming and improvements to the building and the grounds, to enhance its aesthetic appeal as a venue. Again, please refer to the discussion in Item # IX above for potential impacts to neighboring properties. On motion by Greene, seconded by McMahon, the Board authorized payment of County's Warrants and Miscellaneous Bills as follows: The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. " Bills Paid 6/17/2013 $374,646.20 and authorized payment of County's Warrants for HHS: Prepared Check Date Amount Mail Date Type of Payment 06/07/2013 $16,286.26 County's Warrants 06/07/2013 $23,943.69 06/19/2013 Auditor's Warrants On motion by McMahon, seconded by Greene, the Board moved to authorize the proposed facility maintenance projects, contingent upon County Attorney's and County Administrator's final review and approval. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. The County Board discussed possible funding options for future road and bridge projects and activities. No action was taken. A motion made by Commissioner Greene to cut the proposed 2014 levy by 1%, motion died for a lack of second. On motion by McMahon, seconded by Greene, the Board moved to make the levy the same or up to 1% lower for the upcoming year and for staff to work on budgets within those parameters as they plan for the upcoming year. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. On motion by Greene, seconded by McMahon, the Board moved to continue the discussion relating to Board communications and conduct to the next meeting date. County Administrator Messelt reviewed the following items of correspondence with Board: AMC District 5 materials. No action was taken. On motion by McMahon, seconded by Greene, the Board moved to not discuss the sales tax option for capital improvement projects this year. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. On motion by McMahon, seconded by Greene, the Board moved to place discussion of a possible wheelage tax on the July 17, 2013 Board of Commissioner's Meeting agenda as a possible way to raise revenue for transportation improvement and maintenance projects. The motion carried as follows: IN FAVOR THEREOF: Greene, McMahon, Montzka, Robinson OPPOSED: None EXCUSED: Walker. Several Commissioners offered reports of their respective committee assignments. No action was taken.
